Terms of Use

These Terms of Use constitute a legally binding agreement between you and BENEL ASSETS LLC (“Company,” “we,” “us,” or “our”) and serve as the End User License Agreement (EULA) for the Atomic Coaching AI application (the “App”). These Terms of Use (the “Terms”) govern your access to and use of the App.

By accessing or using the App, you agree to be legally bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into this agreement

2. Description of Services

The App provides AI-generated conversational coaching for personal development, informational, and reflective purposes.

The App utilizes artificial intelligence models to generate responses dynamically based on user input and selected preferences.

You acknowledge:

• The service is automated and algorithmic
• No human coach is providing real-time responses
• Outputs are generated probabilistically

3. No Professional Advice

The App is NOT a substitute for professional services.

The App does not provide:

• medical advice
• mental health treatment or therapy
• psychological diagnosis
• legal advice
• financial advice

You agree that:

• You will not rely on the App as a substitute for licensed professionals
• You are solely responsible for any decisions you make

If you are in crisis, you must contact appropriate emergency or professional services.

4. AI-Specific Limitations

You acknowledge and agree:

• The App uses artificial intelligence systems that may:
  • produce inaccurate or misleading information
  • generate content that is incomplete, outdated, or inappropriate
• AI outputs do not represent factual truth or verified knowledge
• The system has no consciousness, intent, or awareness

The Company makes no guarantees regarding:

• accuracy
• reliability
• effectiveness
• outcomes

5. Public Figure Simulation Disclaimer

The App may allow users to select or interact with coaching styles that are inspired by or associated with publicly known individuals.

You expressly acknowledge and agree:

• The App is NOT affiliated with, endorsed by, or connected to any public figure
• Any references are based on publicly available information and generalized characteristics
• AI-generated outputs do NOT represent the actual views, words, or opinions of any individual
• Any resemblance is coincidental, interpretive, and for informational or entertainment purposes only

6. User Responsibility

You agree:

• You are solely responsible for your use of the App
• You will independently evaluate all outputs
• You will not treat outputs as authoritative guidance

7. Accounts

You are responsible for:

• maintaining the confidentiality of your account
• all activity conducted under your account

We reserve the right to suspend or terminate accounts at our sole discretion.

8. Subscriptions & Billing

Subscriptions are offered on a recurring basis.

You agree:

• Subscriptions automatically renew unless canceled
• Payments are processed via:
  • Apple App Store (iOS)
  • Stripe (web, if applicable)

Apple-specific terms:

• Billing is handled by Apple
• Refunds are subject to Apple’s policies
• Subscription management must be done via Apple settings

We reserve the right to modify pricing at any time.

9. Acceptable Use

You agree not to:

• misuse, exploit, or reverse engineer the App
• use the App for unlawful purposes
• attempt to manipulate AI outputs for harmful uses

10. Intellectual Property

All rights, title, and interest in the App are owned by BENEL ASSETS LLC.

You are granted a limited, non-exclusive, revocable license to use the App.

11. Termination

We may suspend or terminate your access at any time, without notice, for any reason.

12. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, including:

• merchantability
• fitness for a particular purpose
• non-infringement

13. Limitation of Liability

To the fullest extent permitted by law:

BENEL ASSETS LLC shall not be liable for:

• indirect, incidental, or consequential damages
• emotional distress
• reliance on AI-generated content

Maximum liability is limited to the total amount paid by you in the past 12 months.

14. Indemnification

You agree to indemnify and hold harmless BENEL ASSETS LLC from any claims arising from:

• your use of the App
• your reliance on outputs
• your violation of these Terms

15. Governing Law

These Terms shall be governed by the laws of the applicable jurisdiction of BENEL ASSETS LLC (to be finalized).

16. Changes

We may modify these Terms at any time. Continued use constitutes acceptance.
